1 - OUR COMPANY :

ALOA, identified by the domain name www.art-full.com, is a commercial company under French law, a limited liability company with a share capital of 68, 000 French Francs founded in November 1996, and registered at the Aix en Provence Commerical Companies register under the number B 510004519.

2 - YOU WISH TO PROCEED WITH PURCHASING A WORK OF ART ON OUR SITE:

To order a work of art from our site you can contact us by telephone, fax or e-mail.

We will provide you with the identification, the characteristics and the total price of the work of art including all taxes in accordance with the applicable legislation, excluding shipping charges, as well as the chosen means of payment.

After agreement by both parties on the subject of the transaction, the price, and the method of delivery, each party will execute its obligations:

• For you: Proceeding with payment of the total price, in accordance with the
agreed terms.
For payment by cheque, a clearance period of 20 days will be applied before
delivery.

• For us, ALOA company: Forwarding to you the contractual documents,
notably the Bill of Sale indicating the purchase price, and the complete
identification of the object acquired.
Proceeding with despatch and delivery of the work of art, either directly, or via
the intermediary of an ALOA approved transport company. The liability of
ALOA company is transferred to the transport company at the time of
transferring the object to the latter.



3 - HOW IS THE TRANSACTION CONDUCTED ?

You can pay for your purchases by a cheque drawn on a French bank. The cheque may be written in French Francs or Euros, payable to ALOA and forwarded to the following address:

The price confirmed by telephone, fax or e-mail corresponds to the total amount of your payment. It includes the price of the work of art, and the packing and transport charges.

The prices are quoted in French Francs and Euros.

For customers in France and European Union member countries, the prices quoted include all taxes.



4 - DELIVERY METHODS :

Delivery will be made, during working hours, to the delivery address of your wishes, within a period of 15 days after the date on which we confirm acceptance of your order.

The transfer of risk relating to the works of art you purchase occurs at the time of transfer to the transport company.

In the event of goods being missing or damaged on delivery, it is your responsibility to formulate precise and detailed reserves to the transport company at the time of delivery and, at the latest, three days (public holidays excluded) after delivery by registered letter with acknowledgement of receipt to ALOA.



5 - REIMBURSEMENT :

In accordance with Article L 121-16 of the Consumer Code, you have a period of 7 clear days after the date of delivery of your order to return the work of art ordered in order to exchange it or obtain a reimbursement, without penalties (excluding the costs of returning the article, which are for your account).

If this period expires on a Saturday, Sunday or Public Holiday, it is extended to the first following working day.

In order to exercise this right you must send us an electronic message to the following address: art-full@wanadoo.fr indicating to us the motive for the return.. ALOA will then confirm to you an address for returning works of art.



6 - WORKS OF ART REPRODUCTION RIGHTS :

The artist, for having taken the initiative with his/her creation, remains the owner of the copyright to his work, under French law. The rights for representation and reproduction of the works of art presented on the art-full.com site belong to their authors and to ALOA. Their joint approval is required for any usage of these rights.

Therefore, your rights to the work of art purchased are limited to private usage, excluding all rights to representation and reproduction.



7 - WORKS OF ART AUTHENTICATION :

All the works of art presented on our site are originals, with the exception of posters and any work where the mention "copy" is confirmed. An invoice, receipt or advice containing notably the specifications provided at the time of order and relating to the nature, composition, origin, and age of the work of art will be supplied on simple request.



8 - CAUSES OF FORCE MAJEURE :

ALOA will not be held liable and will not be considered as having failed in its obligations in processing your dossier prior to the conclusion of the Contract or in the performance of the latter, if such a delay or non-performance is the result of a case of force majeure in compliance with Article 1148 of the Civil Law Code, as interpreted by French jurisprudence.



9 - GUARANTEES :

ALOA undertakes to respect all legal guarantees to which you have the right.

As the works of art presented on our site comply with the provisions of French law, we will not be held liable for violations to the particular legislation of the country of delivery of any work of art. Consequently, we invite you to become aware to the law currently applicable in the country of delivery.



10 - APPLICABLE LAW :

The contract is subject to French law. Any dispute arising from the conclusion, interpretation and performance of the Contract will be subject to the sole jurisdiction of the courts of France.
